Appleton Armed Robbery Lawyer

Armed Robbery

Although many people use the terms interchangeably, there is a legal distinction between “theft” and “robbery.” Theft is taking another person’s property with the intent to permanently deprive the victim of that property. Robbery is committing theft in the victim’s presence, using force to stop the victim from preventing the theft.

If a person uses or threatens to use a dangerous weapon, or an object designed to look like one, while committing robbery, he or she will be charged with armed robbery. While simple robbery is a Class E felony, armed robbery is a Class C felony, and is punished much more severely.

If you have been accused of committing armed robbery, an experienced Appleton armed robbery defense attorney from Kohler, Hart & Priebe can work to defend your rights.

Penalties for Armed Robbery

If a first-time offender is convicted of armed robbery, he or she will be facing the following penalties:

  • A fine up to $100,000
  • Up to 40 years in prison

Not every defendant will face one or both of these penalties, however. The sentence can change based on many variables, including the severity of the crime and the risk that the defendant will offend again if released from prison.

Factors that affect the severity of the crime include, but are not limited to:

  • Abduction or restraint of the victim
  • Vulnerability of the victim
  • Manipulation or coercion of the defendant to commit the crime
  • Defendant’s abuse of a position of authority or trust

Factors that affect the risk assessment of the defendant include, but are not limited to:

  • Prior convictions
  • Drug or alcohol dependence
  • Current or former psychiatric treatment
  • Age
