Four time sex offender sentenced to life in prison and denied appeal

by Administrator 14. December 2011 08:18

Four time sex offender, James M. Wappler, 38, of Sheboygan, was denied his appeal of a life sentence in prison after molesting a 10 year old girl in 2008.

Wappler originally pleaded no contest, and this crime involved a Wisconsin 'two strikes' clause in the state legislature that requires a life sentence in prison.  After sentencing, Wappler then claimed he didn't know about the required life sentence and appealed.

According the appeals court, Wappler had been notified numerous times of the life term penalty, but Wappler stated, “I understand that you may not have no choice but to sentence me to life, but I feel that I’d be discriminated against based on unfair application of the two strike law."  Others have not been subject to the clause in the past.

The court upheld Judge L. Edward Stengel's ruling on Wednesday morning.

Precautionary measures taken by police on Halloween against sex offenders

by Administrator 3. November 2011 11:37

On Monday in Appleton, police set up monitoring of sex offenders during trick-or-treating time. Handing out candy or interacting with children on Halloween is prohibited by the Corrections Dept for offenders who are on parole, probation, or extended supervision for a sex crime.

Random checks were administered on registered offenders according to Jason Weber of the Menasha Police Department.  Appleton police performed the checks specifically when children were trick-or-treating.

Some are unsure that the checks will actually make the communities safer because most offenders have relationships already established with the child.

The man was one of four who were arrested in October by Appleton police with the assistance of an internet watchdog group. Appleton Man Arrested for '03 Sexual Assault

by Administrator 1. October 2010 05:02
A man in Appleton pleaded guilty to a charge of first-degree rape stemming from an 2003 assault.

According to court documents, 31 year-old Donnell Thomas Bellamy pleaded guilty before County Circuit Court Judge Paul A. Hackner. Bellamy attacked a 13 year-old girl on July 2, 2003. Police say the victim was walking to a friends house around 12:30 a.m. when she was stopped "two minutes" from her fathers house by a man in a dark car. The man said if she didn't get in, he would kill her, Assistant State Attorney Kathleen Rogers said.

Bellamy was charged after DNA samples were matched to genetic material recovered from cold cases in state and federal databases. Authorities got a hit earlier this year and detectives arrested Bellamy at his home in Appleton.

Convicted Sex Offender Stands Trial for New Crimes

by Administrator 19. July 2010 02:54

The Appleton Post Crescent reports that, "Prosecutors will ask a judge to allow evidence from a 1992 sexual assault at the trial for a registered sex offender who's now accused of inappropriately touching a 6-year-old."

45-year-old Jeffery Walker stands accused of eight counts of sexual assault. Four of these counts are for "first degree sexual assault as a persistent repeater," writes the Crescent.

This evidence, if allowed, can prove a pattern in how Walker lures his victims. According to prosecutors, he lures them into a private place that is right next to a public place. In one of the most recent events, he lured a young girl from a swing set near a motel where they both happened to reside. The girl reported that Walker touched her inappropriately on four to five occasions in one day. He then told her not to tell anyone.

Walker's trial date is set for August 17.
