Murder Defendant’s Defense Challenges Search Warrant

LISBON, Oh. -Murder suspect J.C. Amato Jr.'s defense plans to challenge the grounds on which a search warrant was obtained.  The proceedings resulted in additional charges filed against Amato. According to the defense attorney's statement to the Columbiana County Common Please Court judge, he intends to file such a motion because of what he believes are major legal defects with the warrant issued on Sept. 17.  The warrant was used to search the Yellow Creek Township home of the defendant's parents. Amato Jr. has been living with his parents while awaiting trial on Feb. 17 for the murder of his wife in the summer of 2007.  He admitted to shooting his wife at their home, but claims it was in self defense after she fired a handgun at him while they were arguing. Investigators obtained a warrant to search the parent's residence for the handgun believed to have been used to shoot the wife because the firearm that the authorities had in possession did not match the bullet recovered at the scene.  Investigators found various firearms and pipe bombs in Amato Jr.'s bedroom during the search.  As a result, the defendent was indicted for possessing weapons while under indictment. Amato Jr. remains in the county jail since his arrest on the weapons charge.  Due to trial requirements, he must go to trial by mid-December or the charge against him will be dismissed.
